Telecommunications law represents one of our law firm’s most important specialisations. We understand the business environment in this area very well and are able to reflect its specifics in the provision of telecommunications services to an appropriate extent.

We provide legal services primarily as part of transactional advice and regulation of electronic communications at the Czech and EU levels. Our advisory services also include negotiating and concluding contracts for wholesale and retail telecommunications services, drafting model documentation, negotiating with the Czech Telecommunications Office, building and using infrastructure, and providing comprehensive support primarily to foreign entities in their entering the electronic communications market.

TELECOMMUNICATIONS REGULATION

  • Providing comprehensive legal support regarding doing business in the telecommunications sector
  • Representation in proceedings before the Czech Telecommunications Office
  • Providing support in entering the telecommunications market, including business notifications and mandatory reporting
  • Providing continuous support in connection with the telecommunications sector (compliance, GDPR, cybersecurity, and corporate criminal liability)

COMPREHENSIVE SETING UP OF CONTRACTUAL DOCUMENTATION

  • Preparing and negotiating supplier-customer relations, including interconnection contracts
  • Comprehensive setting up of contracts and general terms for end customers (B2B and B2C)
  • Setting up the contracting process with customers, including employee training (electronic legal acts, information obligation towards consumers, and internal documentation preparation)
  • Conducting legal due diligence and remedying identified deficiencies reflecting primarily the decision-making practice of the Czech Telecommunications Office and of the Office for Personal Data Protection, and legislative changes

  • Representing clients in proceedings before the Office for the Protection of Competition
  • Defining relevant markets
  • Determining market power and dominance
  • Assessing the impact of specific legal conduct on competition in the market
  • Advising on regulation, commercial disputes, and business strategy
  • Drafting expert analyses and opinions (legal and economic) related to competition in the telecommunications sector

TRANSACTIONAL SUPPORT

  • Advising on sales, purchases and other transformations of companies, including transactions containing foreign elements
  • Conducting due diligence in connection with transactions
  • Technology transfers
  • Providing support in network construction (including NGA)

DISPUTE RESOLUTION

  • Representation in subscriber disputes in connection with the provision of services (amounts due and opposition proceedings)
  • Ensuring interim measures in emergency situations in connection with doing business in the telecommunications sector

  • Data handling, data transfers, and GDPR
  • Advice related to cyber security incidents
  • Frequency allocation and other specific issues

CONSTRUCTION AND ADMINISTRATIVE LAW

  • Applying practical advantages under the Act on Measures to Reduce the Costs of Deploying High-Speed Electronic Communications Networks
